Acceptable Use Policy
This Acceptable Use Policy ("AUP") applies to all users of the Postmaster Ops sending-infrastructure service ("Service"), operated by Oliver DeNune INC. This AUP is incorporated by reference into the Terms of Service and forms a binding part of the agreement between Postmaster Ops and Customer.
§ 01 Purpose & Scope
Postmaster Ops was built for high-volume commercial outbound to Gmail addresses in verticals conventional ESPs decline to serve. This AUP exists to (a) make explicit the verticals we take and the verticals we categorically refuse, (b) prohibit technical behavior that would compromise fleet reputation or upstream trust, and (c) codify the minimum consent and list-hygiene expectations for every Customer.
Vetting call resolves edge cases before an account is provisioned. If a use case is not clearly permitted or clearly refused below, both parties will discuss it during onboarding and either proceed with documented conditions or decline.
Target jurisdictions must be declared during onboarding. Gmail addresses do not disclose recipient location, so Postmaster Ops cannot infer where your recipients live. Customer is responsible for identifying and documenting the jurisdictions targeted by each sending program — including any planned expansion — so that vertical-specific restrictions (licensing, age of majority, securities registration, anti-spam law, adult-content laws) can be assessed against the correct legal framework. Sending into jurisdictions not previously disclosed to Postmaster Ops is a material breach of this AUP.
§ 02 Permitted Verticals
The following commercial verticals are permitted subject to compliance with Sections 4–7 below:
- Business-opportunity ("bizop") and direct-response marketing
- Supplements, nootropics, weight-loss offers (with substantiated claims)
- Regulated gambling operators, upon documented evidence of licensing in the jurisdictions to which they intend to send
- Multi-level marketing and network marketing
- Digital-asset products and offerings that the Customer can demonstrate may lawfully be marketed in every targeted jurisdiction (which may include lawful non-security tokens and registered offerings; unregistered securities in registration-required jurisdictions remain categorically refused)
- Dating & relationship products
- Adult content, on a case-by-case basis and tier-limited
- Any lawful commercial vertical that has been shut out of mainstream ESPs for reasons of category-level policy rather than individual misconduct
§ 03 Categorically Refused
The following are categorically refused and are grounds for immediate termination without cure:
- Romance scams, catfishing, or any operation involving the fabrication of an individual identity to induce financial transfer or intimate exchange
- Phishing, credential harvesting, or any impersonation of a real person, business, or brand in a way calculated to deceive
- Offerings of unregistered securities in any jurisdiction requiring registration for such offerings
- Child sexual abuse material (CSAM), any content sexualizing minors, or any depiction or promotion involving persons under the age of majority in the applicable jurisdiction
- Human trafficking, sex trafficking, coercion, or any commercial activity involving non-consenting persons
- Non-consensual intimate content of any kind
- Prescription pharmaceuticals absent verifiable pharmacy licensing
- Gambling promotions directed into jurisdictions in which the operator is not licensed to accept play
- Content promoting or facilitating violence, terrorism, or hatred directed at a protected class
- Any activity a reasonable person would recognize as fraudulent or otherwise illegal in the jurisdiction of the sender or the recipient
§ 3A Adult Content — Specific Requirements
Because adult content is an accepted vertical (case-by-case, tier- limited), Customers sending adult content must comply with the following requirements in addition to every other provision of this AUP:
- All performers and depicted individuals must be verifiably of the age of majority in every jurisdiction involved in production or consumption. Customer must retain age-verification records for its performers and be able to produce them on Postmaster Ops's reasonable request.
- Sexually oriented commercial email addressed to recipients who
have not given prior affirmative consent must include the label
"
SEXUALLY-EXPLICIT:" at the start of the subject line and must not include sexually oriented material in the portion of the message that appears before the recipient takes any action to view the full content, as required by the FTC's Adult Labeling Rule (16 C.F.R. Part 316). - All sending must respect jurisdictional restrictions on adult content, including but not limited to age-verification requirements imposed by specific US states and by non-US jurisdictions. Customer is responsible for identifying and complying with applicable restrictions in every jurisdiction targeted.
- Recipient lists must be built with explicit age-gating; sending adult content to recipients whose age has not been verified is prohibited.
- No adult content may be sent to any recipient who has unsubscribed, or to any recipient in a jurisdiction in which the specific content depicted is illegal to distribute.
Non-compliance with this Section 3A is treated as a categorical AUP violation under Section 03 and is grounds for immediate termination.
§ 04 Technical Prohibitions
Regardless of vertical, the following technical behaviors are prohibited:
- Use of harvested, scraped, or purchased email lists absent an independently-verifiable lawful basis for each address
- Forged, obscured, or otherwise deceptive email headers, envelope addresses, or message-ID chains
- Deceptive subject-line construction, including false
Re:orFwd:prefixes on messages that are not genuine replies or forwards, and false reply-chain construction in the message body - URL cloaking, deceptive redirects, or any technique designed to conceal the true destination of a click-through link from the recipient or from filtering systems
- Sending from a domain the Customer does not lawfully control or is not authorized to use
- Spam-trap evasion, including any technique intended to detect and exclude honeypot addresses from a send while continuing to mail other unconsented recipients
- IP or domain rotation designed primarily to evade reputation-based filtering rather than to distribute legitimate load
- Circumventing suppression, or any technique designed to hide sending volume or identity from Postmaster Ops or from receiving ISPs
- Attempting to relay third-party mail through Postmaster Ops infrastructure (open-relay or unauthorized reseller behavior)
- Malware distribution, exploit delivery, or any payload that would compromise the recipient's device or account
- Deliberate degradation of the Service, or interference with other Customers' use of the Service
4.1 Downstream Marketers & Affiliates
Customer is responsible for the conduct of any affiliate, downstream marketer, or third party sending on Customer's behalf through the Service. Actions of such parties are attributed to Customer for AUP purposes. Customer must contractually bind its affiliates to obligations no less restrictive than this AUP.
§ 05 Consent & Legal Basis
Customer is solely responsible for establishing and maintaining a lawful basis to contact each recipient of Customer Content. That basis must comply with the requirements of each jurisdiction applicable to the send (typically determined by the sender's location, the recipient's location, and the offer's target market), including without limitation:
- United States (CAN-SPAM Act, 15 U.S.C. § 7701 et seq.): accurate sender identity, non-deceptive subject lines, clear identification of the message as an advertisement or promotion where required, a functional unsubscribe mechanism that remains operational for at least 30 days after the message is sent, opt-out honored within 10 business days, and physical postal address in every message.
- Canada (CASL): express or implied consent as defined by the statute, sender identification, functional unsubscribe.
- European Union & United Kingdom (GDPR / UK GDPR / ePrivacy): lawful basis under Article 6, transparent notice at the point of collection, honored right to withdraw consent, honored data-subject rights.
- Any additional jurisdictional requirements applicable to the Customer's audience.
Postmaster Ops does not verify the lawful basis of every address at the time of send. However, Customer must be able to produce, upon reasonable request, evidence supporting the lawful basis for material subsets of its sending.
§ 06 List Hygiene
Every Customer is expected to maintain the following minimum list- hygiene practices:
- A functional RFC 8058 one-click unsubscribe mechanism in every commercial message (Postmaster Ops wires this by default; do not disable it)
- Immediate propagation of unsubscribe events into Customer's active-send list and into Postmaster Ops's per-customer suppression identifier list
- Suppression of hard-bounced addresses; not more than three consecutive resend attempts to an address returning soft bounces without intervening successful delivery
- Recipient-specific opt-outs, abuse complaints, and complaint events received through sources that identify the recipient must be suppressed immediately. Google Postmaster data is aggregate (spam- rate and campaign-level Feedback Loop) and is used for domain-level and campaign-level remediation rather than per-recipient suppression.
- Regular re-engagement or sunset of long-cold segments to prevent complaint accumulation from disengaged recipients
§ 07 Complaint & Reputation Thresholds
Postmaster Ops monitors the following signals per Customer and per sending domain:
- Aggregate user-reported spam rate (via Google Postmaster Tools)
- Sustained bounce rate and pattern of deferrals
- Upstream carrier abuse reports
- Third-party complaint feeds where available
Google recommends bulk senders keep the user-reported spam rate below 0.10% and avoid 0.30% entirely. Postmaster Ops operates the following escalation:
- Above 0.10% — internal warning and review; outreach to Customer with recommended remediation.
- Approaching 0.30% — corrective action, which may include throttling of sending volume from the affected domain, at Postmaster Ops's discretion, to protect fleet reputation.
- At or above 0.30% — immediate traffic pause on the affected domain may be imposed to protect the fleet. Continued escalation triggers the reputation-cause remediation process in the Terms of Service (7-day written-notice cure). Sustained failure to cure is grounds for termination.
Throttling and traffic pauses are operational protections and do not themselves terminate the agreement. Where such protections are imposed, Postmaster Ops will communicate the reason and the path to lifting them.
§ 08 Reporting & Cooperation
Postmaster Ops accepts abuse reports at abuse@postmasterops.com. We commit to acknowledge every substantive report within 72 hours and to investigate promptly.
Customer agrees to cooperate in good faith with any investigation Postmaster Ops undertakes in response to a credible abuse report, including by providing (a) evidence of consent for material subsets of sending, (b) documentation of list acquisition, (c) copies of the landing pages referenced in Customer Content, and (d) other information reasonably needed to assess the complaint.
§ 09 Enforcement
Enforcement follows the procedures set out in Section 6 of the Terms of Service, which is authoritative if any conflict arises with the summary here. In summary:
- Operational protection — throttling or temporary suspension of traffic may be imposed at any time where reasonably necessary to protect the fleet. Operational suspension is not termination and does not affect Customer's cure or refund rights.
- Reputation-related issues — written notice + seven (7) day cure window. Prepaid unused fees pro-rated and refunded on termination.
- Immediate termination without refund — reserved for fraud, phishing, brand or person impersonation, illegal activity, categorically-refused conduct under Section 03, or evasive/deceptive conduct under Section 04 (spam-trap evasion, URL cloaking, filter-evasion IP or domain rotation, false reply-chain construction).
- Repeat borderline conduct after a prior cure period may result in termination without a further cure window, treated as a continuation of the same enforcement event.
§ 10 Appeals
A Customer whose account has been suspended or terminated under this AUP may submit a written appeal to hello@postmasterops.com within thirty (30) days of the enforcement action. Appeals must identify the enforcement action being appealed, describe the facts and reasoning Customer wishes Postmaster Ops to consider, and attach any supporting evidence.
Postmaster Ops will review appeals in good faith and respond within thirty (30) days. Enforcement decisions are final at Postmaster Ops's reasonable discretion. Nothing in this Section limits Customer's contractual rights under the Terms of Service.
